Welcome to The DigiAsset (the “Site”, “we”, “our”, or “us”).
These Terms of Service (“Terms”) govern your use of thedigiasset.com, including all content, products, and services offered through the Site, such as the DigiAsset Sales Booster Bundle and any other digital templates, checklists, prompts, trainings, or memberships (collectively, the “Products”).

By accessing or using the Site or purchasing any Product, you agree to be bound by these Terms.
If you do not agree, please do not use the Site or purchase from us.

1. Who We Are

The DigiAsset is a digital brand providing marketing templates, checklists, AI prompts, and related training for online advertisers, creators, and business owners.

2. Eligibility

By using this Site or purchasing a Product, you confirm that:

  1. You are at least 18 years old or have reached the age of majority in your country.
  2. You have the legal capacity to enter into a binding agreement.
  3. You are using the Site for lawful purposes and in compliance with these Terms.

3. Account & Access

Some Products may require you to create an account or provide an email address for delivery.

  • You are responsible for keeping your login details confidential.
  • You are responsible for all activity that occurs under your account.
  • You agree to notify us promptly if you suspect any unauthorized use.

We reserve the right to suspend or terminate accounts that violate these Terms or are involved in abuse, fraud, or misuse of our Products.

4. Digital Products & License

All our Products are digital (no physical items). When you purchase a Product, you are buying a license to use the digital files, not ownership of the intellectual property.

4.1. What You Are Allowed to Do

Subject to full payment and compliance with these Terms, we grant you a non-exclusive, non-transferable license to:

  • Use the templates, checklists, and prompts for:
    • Your own business / brand
    • Your own ad accounts
    • Your own marketing campaigns
  • Use them for client work where:
    • You deliver finished creatives (images, videos, ads, designs)
    • You do not share the raw template files as standalone products

4.2. What You Are NOT Allowed to Do

You may not:

  1. Resell, share, or distribute the source files (templates, checklists, prompts, PDFs, etc.) as your own product.
  2. Upload or sell our templates on marketplaces or platforms (e.g., Etsy, Creative Market, Fiverr gigs, your own store) as template products.
  3. Claim the Product, designs, or framework as your own intellectual property.
  4. Give away the raw files as a bonus, freebie, or part of another paid course/bundle.
  5. Use the Products in any way that violates laws, infringes copyrights, or promotes hate, abuse, or illegal activities.

If we reasonably believe our Products are being pirated, shared, or resold, we may:

  • Revoke access without refund
  • Block future purchases
  • Take legal action if necessary

5. Pricing, Payments & Taxes

  • All prices are listed in Pakistani Rupees (Rs.), unless stated otherwise.
  • We reserve the right to change prices, run promotions, or discontinue Products at any time.
  • Payment is processed securely through our payment providers (such as card processors, banks, wallets, or local gateways).
  • Any taxes, bank charges, or currency conversion fees are your responsibility.

By placing an order, you confirm that:

  • You are authorized to use the payment method, and
  • All billing information provided is accurate, complete, and current.

6. Delivery of Digital Products

After successful payment:

  • You will receive instant access via:
    • A download link on the checkout/thank-you page, and/or
    • An email with access links or instructions, and/or
    • Direct access inside your account (if applicable).

If you do not receive access within a reasonable time:

  • Check your spam/junk folder
  • If still missing, contact support@thedigiasset.com with your order details and we will re-send access.

7. Refund & Returns

We offer a 14-day money-back guarantee on eligible digital Products, including the DigiAsset Sales Booster Bundle, under specific conditions.

  • For full details, please read our Refund & Returns Policy, which is incorporated into these Terms by reference.
  • By purchasing, you acknowledge that you have read and agreed to that policy.

If you request and receive a refund:

  • Your license is revoked, and
  • You must stop using and delete any copies of the Product files.

8. Use of Third-Party Platforms & Tools

Our Products are designed to work with certain third-party platforms and tools, such as:

  • Canva (for templates)
  • Meta / Facebook / Instagram Ads Manager
  • Email marketing tools or other software

Important notes:

  • These platforms are owned and operated by third parties and have their own terms & policies.
  • We are not affiliated with or endorsed by Canva, Meta, or any other third-party platform mentioned.
  • You are responsible for having your own valid accounts and respecting their rules.

We are not responsible for:

  • Changes made by third-party platforms
  • Policy updates, account bans, or ad rejections
  • Technical issues on third-party services

9. Testimonials & User Stories

We may display testimonials, reviews, or results shared by real customers and creators.

  • These are individual experiences and do not guarantee that every customer will achieve the same results.
  • By sending us a testimonial (text, screenshot, video, or message), you grant us a non-exclusive, worldwide, royalty-free license to display, reproduce, and use it for marketing across our Site, social media, and ads, unless you explicitly request otherwise.

If you ever want your testimonial removed, contact us at support@thedigiasset.com and we will cooperate as reasonably possible.

10. No Earnings or Results Guarantee

Our Products are tools to support your marketing, not magic buttons.

We do not guarantee:

  • Specific sales numbers
  • Specific CTR, ROAS, or profit
  • That your ads will be approved or never banned
  • That you will get clients or students

Your success depends on many factors including your:

  • Offer, pricing, targeting, audience, market, competition, and execution.

All examples and case studies are for educational purposes only.

11. Intellectual Property

Unless otherwise stated, all content on this Site and inside our Products is owned or licensed by The DigiAsset, including:

  • Designs, layouts, text, graphics, icons
  • Templates, checklists, prompts, training materials
  • Logos, branding, and overall look & feel of the Site

You agree not to:

  • Copy large portions of our Site or Products
  • Remove copyright or branding notices
  • Use our trademarks or brand assets without written permission

12. Acceptable Use & Prohibited Activities

You agree not to use the Site or Products to:

  • Engage in illegal, fraudulent, or deceptive activities
  • Harass, threaten, or abuse others
  • Upload viruses, malicious code, or attempt to hack the Site
  • Scrape or harvest data without permission
  • Reverse engineer or bypass security features

We may suspend or terminate your access if we believe you are violating this section.

13. Availability & Modifications

We aim to keep the Site and Products available and updated, but we:

  • Do not guarantee uninterrupted or error-free operation
  • May change, update, or discontinue any part of the Site or a Product at any time without prior notice
  • May update these Terms from time to time

When we update these Terms, we will change the “Last updated” date at the top.
Your continued use of the Site or Products after changes means you accept the new Terms.

14. Disclaimer of Warranties

To the fullest extent permitted by law:

  • The Site and Products are provided on an “as-is” and “as-available” basis.
  • We disclaim all warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, merchantability, and non-infringement.
  • We do not warrant that:

    • Any results from using the Products will be accurate or guaranteed

You use the Site and Products at your own risk.

15. Limitation of Liability

To the maximum extent permitted by law:

  • The DigiAsset, its owners, team members, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or business opportunities, arising from your use of the Site or Products.
  • Our total liability for any claim related to a Product will not exceed the amount you paid for that Product.

Some jurisdictions do not allow certain limitations of liability; in such cases, these limitations apply to the fullest extent permitted by applicable law.

16. Indemnification

You agree to indemnify, defend, and hold harmless The DigiAsset and its team members from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of:

  • Your use of the Site or Products
  • Your violation of these Terms
  • Your violation of any law or third-party rights

17. Governing Law & Dispute Resolution

These Terms are governed by and interpreted in accordance with the laws of Pakistan, without regard to conflict of law principles.

  • Any disputes will be subject to the exclusive jurisdiction of the courts located in Pakistan (you can change to a specific city if you want, e.g., Lahore).
  • Before going to court, both parties agree to first try to resolve the matter informally via email and communication in good faith.

18. Severability

If any part of these Terms is found to be invalid or unenforceable, that part will be interpreted in a way that reflects the original intent as closely as possible, and the remaining sections will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and Refund & Returns Policy, form the entire agreement between you and The DigiAsset regarding your use of the Site and Products, and supersede any prior agreements or communications.
